Right of Withdrawal (General Rules and Form/Button) Pursuant to Article 52 of Legislative Decree 206/2005 (Consumer Code), the Customer (if classified as a "consumer") has the right to withdraw from the contract without stating any reasons, within 14 days of receiving the goods. 6. EXCEPTIONS TO THE RIGHT OF WITHDRAWAL (Cosmetics and Gift Cards) In accordance with art. 59 of the Consumer Code, the right of withdrawal is expressly excluded in the following cases:
Cosmetic Products: The supply of sealed goods which are not suitable for return for reasons of hygiene or related to the protection of health and they were opened after delivery. Therefore, returns of creams, serums, or similar products that are opened, have the warranty seal removed, or have been used, even partially, will not be accepted or refunded under any circumstances.
Digital Gift Cards: The supply of digital content on a non-material medium if the performance has begun with the express consent of the consumer (for example, a Gift Card sent by email and already downloaded or used for a reservation/purchase).
7. Returns and Refunds In the event of a valid return (e.g., cream still perfectly packaged and sealed), the direct cost of returning the goods will be borne by the customer. Once the returned item has been received and inspected to verify its integrity, we will refund the amount paid via the same payment method used at the time of purchase as quickly as possible.
8. Applicable law and competent court The sales contract between the Customer and Amato Medical Institute is deemed to have been concluded in Italy and is governed by Italian law. For the resolution of civil and criminal disputes arising from the conclusion of this distance selling contract, the competent court is the court of the Customer's municipality of residence, if located in Italy.
